Submission: Defamation Law Reform review

Allens Hub researcher Dr Daniel Joyce has made a submission to the Defamation Working Party in response to its discussion paper which identifies areas for national defamation law reform. 

A number of questions were posed to ascertain whether the existing laws are meeting their policy objectives, particularly in response to the rise of online publications and technological changes since the provisions were enacted in 2005. 

The submission focuses especially on media freedom, freedom of expression, proportionality, costs and the responsibility of new actors such as search engines.  It also draws attention to the need for reforms in the wider media law landscape including a bill of rights and privacy protection.”
